This document is a translation of User Agreement for Dimini site in English. General Provisions

Dimini Inc. (hereinafter – “Dimini”) offers Internet users (hereinafter – the “User”) the opportunity to use its site on the terms and conditions of this User Agreement (hereinafter - the “Agreement”, “User Agreement”). This Agreement shall take effect upon the User’s express agreement with its terms according to Agreement.

The use of site shall be regulated by this Agreement and Privacy Policy. This Agreement may be amended by Dimini without notice, and a new revision of this Agreement shall take effect when posted online at the web address https://legacy.dimini.dev/en/terms-and-privacy, unless otherwise stated in the new revision of this Agreement.

By starting the use of site, the User shall be deemed to have accepted the terms of this Agreement in full without any limitations or exceptions. If the User does not agree to any provisions of this Agreement, the User must not use site. If Dimini makes any amendments to this Agreement as prescribed by User Agreement to which the User does not agree, the User shall cease to use site.

General Usage and Storing Provisions

Dimini may impose restrictions on the use of site for all Users or certain categories of Users (depending on the User’s location, language of part of the site, etc.) including: availability/unavailability of certain site functions, maximum number of site uses in a certain period, special parameters of downloadable content, etc. Dimini may prohibit automatic requests to its servers as well as terminate acceptance of any automatically generated information (for instance, electronic spam).

User Content

The User shall be responsible for compliance of any content posted by the User with applicable legal requirements including responsibility to third parties in case posting by the User of any content or its subject matter infringes on rights and legitimate interests of third parties including personal non-property rights of authors, any other intellectual property rights of third parties and/or encroaches on other intangible assets.

The User acknowledges and agrees that Dimini is not under obligation to review any content posted and/or distributed by the User through site and that Dimini has the right (but shall not be obliged to) at its discretion to prohibit the User from posting and/or distributing content or may remove any content available through site. The User acknowledges and agrees that the User shall independently assess any risks related to using content including its reliability, validity or usefulness.

Terms of Dimini site Use

The User shall be responsible to third parties for any actions related to the use of site including any actions resulting in violation of rights and legitimate interests of third parties as well as compliance with laws upon using the site.

Upon using site, the User shall not:

download, send, transmit or in any other way post and/or distribute any content that is illegal, harmful, slanderous, unethical or violates intellectual property rights, promotes hatred and/or racial, ethnic, sexual, religious or social discrimination or is insulting to any persons and/or organizations;

violate third party rights including underage people and/or cause harm in any way;

impersonate any other person or representative of an organization and/or community without being authorized to do so, including employees of Dimini, moderators, website owners and apply any other forms and methods of unlawful representation of other persons online as well as mislead other users and Dimini regarding features and characteristics of any subjects or objects;

download, send, transmit or otherwise post and/or distribute content if not authorized to do so by law or contract;

download, send, transmit or otherwise post and/or distribute unauthorized advertising information, spam (including spamdexing), lists of e-mail addresses of other people, pyramid schemes, multilevel marketing (MLM), Internet earning systems and e-mail businesses, chain letters as well as use Dimini site for participation in any of the above;

download, send, transmit or otherwise post and/or distribute any materials containing viruses or other computer codes, files or programs designed to breach, destroy or limit the operation of any computer or telecommunication equipment or software, for unauthorized access as well as serial numbers to commercial software and generation programs, logins, passwords and other means to receive authorized access to fee-based online resources, or post links to such information;

collect and store personal information of other persons without proper authorization;

interfere with regular operation of Dimini website;

assist any actions to violate any restrictions and prohibitions imposed by this Agreement;

otherwise violate legal standards including international law.

Exclusive Rights to Site and Content

Any objects available through site including design elements, text, graphics, illustrations, video, software, databases, music, soundtracks and other objects (hereinafter – site content) as well as any content posted at site are exclusive property of Dimini, Users and other right holders.

Any content and site elements may be used only within functions offered by site. No elements of site content as well as any content posted at site may be used in any other way without the right holder’s prior consent. The term “use” shall include reproduction, duplication, processing and distribution on any basis, representation on frame, etc. The exception shall be any cases prescribed by Russian laws or terms of use of Dimini site.
The personal non-commercial use by the User of site content elements and any content is authorized upon preservation of all marks of copyright, associated rights, trademarks, other notices of copyright, preservation of the name (pseudonym) of the author/right holder’s name unchanged and preservation of corresponding object unchanged. The exception shall be cases directly stated by Russian laws or user agreements of site.

Third Party Websites and Content

Dimini site may content links to other websites (third party websites). Such third parties and their content are not verified by Dimini for compliance with any requirements (validity, completeness, accuracy, etc.). Dimini shall not be responsible for any information or materials posted at third party websites that the User may access through the site including any opinions or statements at third party websites, advertising, etc. as well as availability of such websites or content and consequences of their use by the User.

A link (in any format) to any website, product, service, any commercial or non-commercial information published on the Website shall not be considered as approval or recommendation of such products (services, activities) by Dimini, unless directly stated at Dimini website.

Advertising at Dimini website

Dimini shall not be responsible for its advertising at Dimini website.

No Guarantees, Limitation of Liability

The User uses site at his own risk. Site is provided as is. Dimini accepts not responsibility including for compliance of site with the User's goals.

Dimini does not guarantee that site comply/will comply with User's requirements; that site will be provided without interruptions, promptly, sustainably and without errors; that results received with the use of site are accurate and reliable and may be used for any purposes or in any capacity (for instance, for identification and/or verification of any facts); that the quality of any product, service, information, etc. received through the site will meet the User's expectations.

Any information and/or materials (including downloadable software, messages, any instructions and guidelines, etc.) which the User accesses through site may be used by the User at his own risk and the User shall be responsible for any potential consequences of the use of such information and/or materials including any damage to the User’s computer or third parties, loss of information or any other damage.

Dimini shall not be liable for any losses resulting from the User using Dimini website or separate parts/functions of it.

Other Provisions

This Agreement is an agreement between the User and Dimini regarding the procedure of using site and shall replace all previous agreements between the User and Dimini.

This Agreement shall be regulated and interpreted according to laws of the Russian Federation. Any issues not regulated hereby shall be settled according to Russian law. Any disputes arising out of relations regulated by this Agreement shall be settled as prescribed by applicable Russian laws according to Russian legal standards. In any part of this Agreement, unless otherwise stated, the term “law” shall mean laws of the Russian Federation as well as laws of the country of the User’s location.

Due to the fact that site under this Agreement is provided free of charge, standards on consumer rights' protection under Russian laws shall not apply to relations between the User and Dimini.

Nothing in this Agreement shall be interpreted as agency, partnership, mutual activities, employment or any other relations not directly stated in this Agreement.

If for any reasons one or several provisions of this Agreement are declared invalid or unenforceable, it shall not affect the validity or enforceability of the remaining provisions hereof.

Failure by Dimini to act in case of violation by the User or any other users of the provisions of this Agreement shall not deprive Dimini of the right to take action to protect its interests in the future and shall not be interpreted as waiver by Dimini of its rights in case of any future similar or identical violations.

This Agreement is made in the Russian language and in certain cases may be provided to the User for review in a different language. In case of any differences between the Russian text of this Agreement and the text of this Agreement in any other language, the Russian text shall prevail.

Privacy policy

The Personal Information Privacy Policy (hereinafter – Policy) applies to any and all information about the User that Dimini Inc. or its affiliates, including all persons belonging to the same group with Dimini Inc. (hereinafter – Dimini), may obtain in the course of the User’s use of Dimini website (hereinafter – site) and during the performance of any agreements and contracts with the User. The User’s agreement with this Policy within the framework of relations with any of the persons listed above shall apply to all persons listed above.

By using the Dimini site the User expresses his/her unconditional agreement with this Policy and the conditions of processing the user’s personal information contained herein; if the User does not agree with these conditions, the User should not use the site.

User Personal Information Processed by Dimini

According to this Policy, “User personal information” means the following:

Personal information provided by the User in the course of using the site, including the User’s personal details. Information required for the provision of the site is marked respectively. Other information shall be provided by the User at his/her own discretion.

Data automatically transferred by the software installed on the User’s device to the Dimini site in the course of its use, including, but not limited to, IP address, cookies data, the User’s browser data (or any other software used to access the site), performance specifications of the User’s hardware and software, date and time of access to the site, the URL of the page requested and other similar information.

Other information about the User required to be processed according to the terms and conditions governing the use of site.

This Policy only applies to the information required to be processed during the use of Dimini site. Dimini has no control over, and does not bear responsibility for, processing of the information by third-party websites, which the User may access by hyperlinks available on Dimini website.

Dimini will not verify personal information provided by the User and cannot judge on his/her legal capacity. However, Dimini assumes that the User provides true and sufficient personal information and keeps such information up to date. The consequences of providing false or insufficient information are stipulated by the User Agreement for Dimini site.

Purpose of Processing User Personal Information

Dimini only collects and stores personal information required for the provision of the site (or execution of agreements and contracts with the User), except in cases where such information is required to be stored by law for a period prescribed by law.

Dimini will process the User personal information in order to:

Identify a party using the site or a party to an agreement or contract with Dimini;

Provide personalized site experience to the User and perform agreements and contracts;

Contact the User, as well as forward notices, requests and information related to the site and performance of agreements and contracts, and process requests and applications of the User;

Improve the quality of the site, convenience of its use, its further development;

Target advertisements;

Carry out statistical and other kinds of research and analysis based on anonymized data.

Conditions of Processing User Personal Information and Its Provision to Third Parties

Dimini shall store User personal information according to internal regulations on site.

The confidentiality of User personal information shall be maintained, except if the User willingly makes his/her details available to the general public. By using some site functions, the User agrees that a certain part of his/her personal information becomes public.

Dimini has the right to provide User personal information to third parties subject to the following conditions:

The User has expressed his/her consent to such actions;

Such provision is required for the User's use of the site or performance of a particular agreement or contract with the User;

Such provision is stipulated by Russian and other applicable laws, within the scope of the procedure established by the law;

uch provision takes place as part of the sale or other transfer of the business (in full or in part), and all obligations under this Policy in relation to any personal information that the buyer may obtain shall be transferred to the buyer;

In order to secure remedy for Dimini or third parties in the event of a breach by the User of the User Agreement for Dimini site or this Policy;

Anonymized statistical data generated as a result of processing of the User personal information by way of anonymization are provided to a third party to carry out research activities, perform works or render services as requested by Dimini.

When processing the User personal details, Dimini shall be governed by the Russian Federal Law “On Personal Details”.

Processing of personal information by using Cookies and counters

Cookies transferred by Dimini to the User’s devices and by the User’s devices to Dimini may be used by Dimini to provide customized site experience to the User, to target advertising displayed to the User, for statistical and research purposes and to improve the site.

The User understands that hardware and software he/she uses to visit websites may have an option for blocking any actions with cookies (for any websites or for certain websites) and for deletion of previously received cookies.

Dimini may determine that provision of the site is available only subject to the User’s consent to acceptance and receipt of cookies.

Structure, content and technical parameters of any cookie shall be determined by Dimini and may be changed without prior notice to the User.

Counters placed by Dimini within the site may be used to analyze cookies of the User, to collect and process statistical information on the site use, and to ensure the performance capacity of the site, in general, and its certain functions, in particular. Technical parameters of counter performance shall be determined by Dimini and may be changed without prior notice to the User.

User Personal Information Protection Measures

Dimini shall take necessary and sufficient organizational and technical measures to protect User personal information from unlawful or accidental access, deletion, alteration, blocking, copying, distribution, as well as from unlawful actions of third parties.

Amendments to the Privacy Policy. Applicable Law

Dimini has the right to amend this Privacy Policy. After an amendment is made, the latest revision date shall be specified in the updated version. The new version of the Policy shall become effective upon its publication, unless otherwise provided for by the new version of the Policy. The current version shall be available at https://legacy.dimini.dev/en/terms-and-privacy.

This Policy and relations between the User and Dimini arising out of the Policy shall be governed by the law of the Russian Federation.
